combinations of diverse actions taken or ignored, for past, present or future. At the core, inevitably presented and crossed, is grief. But at the beginning and the end is an &#8220;us,&#8221; the reason why this poem stirs me. The words &#8220;as we&#8221; and &#8220;our faces&#8221; acknowledge, in my mind, that grief is shared, and action as well as consequences can be communal. The harmful ones, but the empowering ones as well. <\/p>\n\n\n\n<p>By the way, all the words in this poem also appear in a <em><a href=\"https:\/\/www.congress.gov\/bill\/111th-congress\/senate-joint-resolution\/14\/text#:~:text=14%20%2D%20A%20joint%20resolution%20to,behalf%20of%20the%20United%20States.\">Native American Apology Resolution<\/a><\/em>, signed by then President Obama. Never heard of it? I hadn&#8217;t either &#8211; it wasn&#8217;t a direct apology from the government, but rather apologizing &#8220;on behalf of the people of the United States to all Native peoples for the many instances of violence, maltreatment, and neglect inflicted on Native peoples by citizens of the United States.&#8221; The resolution included an important disclaimer as well: Nothing in it authorizes or supports any legal claims  against the United States, and the resolution does not settle any claims. <a href=\"https:\/\/indianlaw.org\/node\/529#:~:text=The%20version%20signed%20by%20Obama,citizens%20of%20the%20United%20States.%22\">Robert T. Coulter<\/a>, executive director of the&nbsp;<a rel=\"noreferrer noopener\" href=\"https:\/\/indianlaw.org\/\" target=\"_blank\">Indian Law Resource Center<\/a>, pointed to the &#8220;overwhelming silence&#8221; regarding the resolution. &#8220;There were no public announcements, there were no press conferences, there was no national attention, much less international.&#8221; No wonder we didn&#8217;t know.<\/p>\n\n\n\n<p class=\"has-text-align-center\">***<\/p>\n\n\n\n<p> <\/p>\n\n\n\n<p>In a month that has seen the highest Court in the land generally rescind rights that were granted to the vulnerable or those with less power in our social, historical  and political landscape, it is important to remember that we can and must build coalitions. <\/p>\n\n\n\n<p>On June 22, 2023,&nbsp;<a rel=\"noreferrer noopener\" href=\"https:\/\/www.supremecourt.gov\/opinions\/22pdf\/21-1484_aplc.pdf\" target=\"_blank\">the United States Supreme Court refused to hold the United States accountable for water rights it holds in trust<\/a>&nbsp;for the Navajo Nation. Elenis (06\/30\/2023)\">LLC Creative vs Elenis<\/a>, discriminatory behavior was given the green light for a business offering customized expressive services, allowing it to violate state laws prohibiting such businesses from discrimination in sales (as it turns out, the facts presented for this case were based on lies, but the Court seemed to be not caring or oblivious.) The revival of the ugly <a href=\"https:\/\/www.thenation.com\/article\/politics\/supreme-court-303-creative-decision-mystal\/\">spirit of Plessy vs Ferguson<\/a> is going full speed ahead. <\/p>\n\n\n\n<p>And a 6-3 majority on the Court dismantled affirmative action in college admission policies, a process originally granted due to an acknowledgment of structural racism. Note, it did so for elite educational institutions (and likely to extend to businesses and institutions of all kinds focused on diversity, equity and inclusion), but leaving the practice standing for military academies. I am paraphrasing someone who said this first: minorities can die in the bunker, but not share the boardrooms&#8230;) which struck me as particularly apt.<\/p>\n\n\n\n<p>Here is a summary by lawyer and court observer <a href=\"https:\/\/slate.com\/news-and-politics\/2023\/07\/supreme-court-john-roberts-winning-americans-losing.html\">Dahlia Lithwick<\/a> on the outcome of this term &#8211; I am quoting her verbatim because she is succinct and hits the nail on the head.<\/p>\n\n\n\n<p class=\"has-small-font-size\">To see why this term was not some kind of triumph for moderation, consider the decisions that&nbsp;<a href=\"https:\/\/reason.com\/volokh\/2023\/07\/02\/purple-june\/\">commentators have deemed<\/a>&nbsp;huge victories for the left.&nbsp;<em>Moore v. Harper<\/em>&nbsp;simply rejected the independent-state-legislature doctrine, a fringe theory that was rendered toxic by its central role in Donald Trump\u2019s failed coup; at the same time, the court&nbsp;<a href=\"https:\/\/slate.com\/news-and-politics\/2023\/06\/john-roberts-supreme-court-kavanaugh-barrett-allies.html\">awarded itself ongoing authority<\/a>to rein in any state courts that it deems to have gone \u201ctoo far\u201d in protecting democracy,&nbsp;<a href=\"https:\/\/slate.com\/news-and-politics\/2023\/06\/supreme-court-voting-moore-v-harper-time-bomb.html\">codifying a minority viewpoint<\/a>&nbsp;into law.&nbsp;<em>United States v. Texas<\/em>&nbsp;merely&nbsp;<a href=\"https:\/\/slate.com\/news-and-politics\/2023\/06\/red-states-lose-kavanaugh-supreme-court.html\">put a new limit<\/a>&nbsp;on the outrageous collusion between red states and a clutch of rogue Trump judges eager to seize control over immigration enforcement.&nbsp;<em>Haaland v. Brackeen&nbsp;<\/em>followed precedents&nbsp;<a href=\"https:\/\/slate.com\/news-and-politics\/2023\/06\/amy-coney-barrett-supreme-court-native-win.html\">reaching back two centuries<\/a>&nbsp;in upholding Congress\u2019 power to protect Native people; even then, it left the door open to future legal attacks on Indigenous rights.&nbsp;<em>Allen v. Milligan<\/em>&nbsp;affirmed an interpretation of the Voting Rights Act that has stood for&nbsp;<a href=\"https:\/\/slate.com\/news-and-politics\/2023\/06\/john-roberts-brett-kavanaugh-save-voting-rights-act.html\">nearly four decades<\/a>&nbsp;and imposes moderate limits on racial gerrymanders. It was arguably the one clear-cut \u201cliberal\u201d victory of the term, and that\u2019s only because the protection of voting rights has now become coded as an exclusively liberal concern. Even that \u201cwin\u201d came only after the court&nbsp;<a href=\"https:\/\/slate.com\/news-and-politics\/2022\/02\/supreme-court-alabama-racial-gerrymander-roberts-kavanaugh.html\">left an illegal gerrymander<\/a>&nbsp;in place for the 2022 midterms, and after years of attacks on Section 2 of the Voting Rights Act that&nbsp;<a href=\"https:\/\/electionlawblog.org\/?p=137129\">left it much weaker<\/a>&nbsp;than it used to be.<\/p>\n\n\n\n<p class=\"has-small-font-size\">Now consider this term\u2019s victories for the right.&nbsp;<em>Biden v. Nebraska&nbsp;<\/em><a href=\"https:\/\/slate.com\/news-and-politics\/2023\/06\/john-roberts-supreme-court-kills-student-debt-relief.html\">abolished a program<\/a>&nbsp;that would\u2019ve forgiven $430 billion in student debt for 43 million borrowers by concocting&nbsp;<a href=\"https:\/\/slate.com\/podcasts\/amicus\/2023\/07\/supreme-court-decision-in-303-creative-strips-lgbtq-couples-and-families-of-their-dignity\">a self-contradictory theory<\/a>&nbsp;of standing then relying on a \u201cmajor questions doctrine\u201d that&nbsp;<a href=\"https:\/\/slate.com\/news-and-politics\/2022\/06\/west-virginia-environmental-protection-agency-climate-change-clean-air.html\">isn\u2019t a real doctrine<\/a>.&nbsp;<em>303 Creative v. Elenis<\/em>&nbsp;gave for-profit companies a First Amendment&nbsp;<a href=\"https:\/\/slate.com\/news-and-politics\/2023\/06\/supreme-court-lgbtq-gay-wedding-website-discrimination.html\">right to discriminate<\/a>&nbsp;against LGBTQ+ people for the first time ever.&nbsp;<em>Students for Fair Admissions&nbsp;<\/em><a href=\"https:\/\/slate.com\/news-and-politics\/2023\/06\/affirmative-action-decision-supreme-court-bulldozes-college-admissions.html\">put an end<\/a>&nbsp;to race-based affirmative action in higher education as we know it.&nbsp;<em>Jones v. Hendrix&nbsp;<\/em><a href=\"https:\/\/slate.com\/news-and-politics\/2023\/06\/supreme-court-conservatives-jones-hendrix-disaster.html\">condemned innocent people<\/a>&nbsp;to languish in prison under illegal sentences through no fault of their own.&nbsp;<em>Sackett v. EPA&nbsp;<\/em>revoked federal protection over millions of acres of wetlands in&nbsp;<a href=\"https:\/\/slate.com\/news-and-politics\/2023\/05\/samuel-alito-wetlands-opinion-lost-brett-kavanaugh.html\">a grievous blow<\/a>&nbsp;to the Clean Water Act that will devastate sensitive ecosystems, endangered species, flood control, and drinking water. Converting grief to light across our faces, summoning communal resolve to serve justice.
